PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING THE GIVEAWAY.
1.1. By entering the DigIn 2018 Fresher’s Giveaway prize draw (“Promotion”), for a chance to win one of the prizes set out below, entrants agree to be bound by these Terms and Conditions (the “Terms”).
1.2. This Promotion is organised by Hadham Enterprises Limited (t/a DigIn) of 72 London Road, St Albans, AL1 1NS (the “Promoter”).
1.3. The Promoter reserves the right to hold void, suspend, cancel or amend the Promotion or these Terms where it becomes necessary to do so. The Promoter shall notify all entrants of any such cancellation or amendment.
1.4. The winner's name and county can be obtained by sending a stamped addressed envelope to Dig-In at 41 Corsham St, London N1 6DR or an email to email@example.com within 15 of days after the Draw Date.
1.5. The decision of the Promoter shall be final in the event of any dispute regarding the Promotion or these Terms. No correspondence will be entered into with regard to any matter connected to this Promotion.
2.1. The Promotion will open at 8th August 2018 and close 9am on 1st November 2018 (“Closing Date”) UK time (the “Promotion Period”).
2.2. Entries submitted after the Closing Date will be invalid.
2.3. Entries should be made by submitting feedback through the website diginbox.com/go on the product samples you received in the DigIn Box and providing your name and contact details (each an “Entry” or collectively, “Entries”).
2.4. Each entrant can only enter once. The Promoter reserves the right to disqualify any entrant who uses multiple accounts, telephone numbers, e-mail addresses or any technologies which permit multiple entries.
2.5. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
2.6. There will be only 29 winners. Winners will be selected from the valid Entries received by the Promoter.
2.7. We accept no responsibility for any late, lost or misdirected entries including but not limited to messages not received due to technical disruptions, network congestion, loss in service of online entry mechanisms, computer error in transit or any other reason. We cannot enter into correspondence with entrants who experience difficulties with entering online.
3.1. Each entrant must:
3.1.1. not be an employee (or an immediate member of an employee's family or household) of the Promoter or its holdings or subsidiary companies;
3.1.2. not be an employee (or an immediate member of an employee's family or household) of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration;
3.1.3. not be a winner of a Prize; and
3.1.4. be over the age of 18.
3.2. The Promotor may require the winner to provide proof of age.
4.1. The winner will receive one of the following prizes:
4.2. Promotor is not responsible if any part of the Prize is delayed, postponed or cancelled for any reason and winner will not be reimbursed for the ARV of the Prize. Promoter is not responsible if winner does not use the Prize. The Prize is non-transferable and no substitution will be made except as provided herein and at Promotor’s sole discretion. Promotor reserves the right to substitute a prize for one of equal or greater value if the Prize should become unavailable for any reason.
4.3. Limit one (1) Prize per person/household irrespective of whether a winner claims their Prize or not. Actual value of Prize may vary and any difference between actual value and ARV will not be awarded. Any costs associated with Prize receipt and/or use that are not expressly stated above are not included in the Prize package and are the sole responsibility of the winner. Such costs may include, without limitation, transportation, any additional air, ground or other transportation, accommodations, incidentals, tips, telephone calls or other personal costs and expenses not specified herein but in relation to the use or acceptance of the Prize, all of which are the sole responsibility of the winner.
4.4. The winner is responsible for obtaining identification documents required for use of the Prize. Promotor will not replace any lost or stolen prize components or the Prize once they are in the winner’s possession.
5.1. The winner for each available Prize will be chosen after the Closing Date by a random draw performed by a computer process on or before 11.59pm on 1st November 2018 ("Draw Date").
5.2. The Promoter will use reasonable endeavours to contact the winner as soon as practicable after the Draw Date, using the email address provided with the Entry. The Promoter will not amend any contact information once the Promotion entry form has been submitted.
5.3. The winner will be notified by email (using details provided at entry) on or before 9th November 2018 and must provide a postal address to claim their Prize. If a winner does not respond to the Promoter within 14 days of being notified by the Promoter, then the winner's prize will be forfeited, the Promoter will be entitled to select another winner in accordance with the process described above and the winner will be ineligible to be selected for any other Prize.
5.4. The Prize will be sent to the winner by post within 30 days of being notified of their win.
5.5. Any tax or other charges payable as a result of a prize being awarded or received will be the sole responsibility of the winner and Promotor accepts no liability in respect of the same. Winners should seek independent financial advice prior to entering a Promotion and/or accepting a prize if they believe that tax charges of any kind are likely to be relevant to them.
5.6. The Promoter makes no representation or warranty in relation to prizes provided and to the fullest extent permitted by law we shall have no liability to you in relation to any prize, its fitness for purpose, merchantability or otherwise.
5.7. No additional, ancillary or associated costs or expenses are included in any Prize unless stated.
6.2. By submitting Feedback to the Promoter and entering into the Promotion you: (a) agree to your personal data being shared with Promotor and its affiliates for the purposes of administration and fulfilling the Promotion, as well as any other uses set out in these Terms; (b) consent to your Feedback being passed by the Promoter to the suppliers of the product samples in an anonymised format for the purpose of carrying out market research; and (c) agree that you have read the policies listed in clause 6.1.
6.3. Winners may be required to participate in photo, recording, video and/or filming session(s) as a condition of their receipt of any prize. You agree that Promotor shall have the right to use all the resulting publicity materials in any media and in any manner Promotor sees fit including Promoter’s social media pages and website.
6.4. No fees shall be payable to any entrant in relation to the use of publicity materials.
7.1. By entering our Promotion all entrants:
7.1.1. assign to us all rights (including present and future copyright) in their entry and all associated materials;
7.1.2. waive all moral rights in such materials; and
7.1.3. undertake to us that such materials are not and do not represent a breach of any third party intellectual property rights and will not contain anything, which is defamatory, indecent, harassing or threatening and that they will indemnify Promotor for any loss, damage or liability which arises out of any breach of this clause 7.1.3.
7.2. For the avoidance of doubt, all rights in the name and title of the Promotion and the format rights for the Promotion are our sole property and we may exploit the same our absolute discretion.
7.3. The Promoter reserves the right to: a) cancel the Promotion b) remove any Entries from the Promotion that it feels may breach any of these Terms; and c) amend the Terms of this Promotion any time.
Promotor may vary the terms of, or terminate, any Promotion at any time at its absolute discretion. Promotor will not award any prizes if a Promotion is terminated and shall have no liability or responsibility to any individuals which may have entered the relevant Promotion prior to cancellation.
If for any reason a Promotion is not capable of running as planned as a result of any reason beyond Promotor’s control (including but not limited to) technical failures, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness integrity or proper conduct of the Promotion, Promotor reserves the right to cancel, terminate, modify or suspend the Promotion and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem.
A failure by us to enforce any one of the terms and conditions in any instance(s) will not give rise to any claim or right of action by any entrant or prize winner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.
11.1. Insofar as is permitted by law, Promotor, its affiliates, its agents or distributors, or any co-promoters of sponsors of Promotions will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss or damage (whether arising directly or indirectly and howsoever caused). Nor shall Promotor be liable for any personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Promotor, its agents or distributors or that of their employees. Your statutory rights are not affected.
11.2. In the event that Promotor is held to be liable to any individual in respect of any Promotion, its total aggregate liability for all claims made shall be equal to the financial value of the relevant prize that was to be awarded in respect of that Promotion.
In the event that any provision of these Terms held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.
These Terms shall be construed in accordance with and governed by the laws of England and Wales and all disputes relating to them and/or their subject matter shall be subject to the exclusive jurisdiction of the courts of England and Wales.
